Many people think of the terms ‘drug trafficking’ and ‘drug distribution’ as being used interchangeably. The fact is that they are not the same, and the differences between the two can have a significant effect on your criminal case.

Under criminal drug offenses listed in the Ohio Revised Code, drug distribution can occur any time you are in possession of illegal substances and attempt to offer, sell, or otherwise distribute them to others. This applies to illegal ‘street’ drugs, pharmaceuticals, and drug compounds including the following:

  • Marijuana;
  • Heroin and opioid type medication;
  • Cocaine;
  • Methamphetamine;
  • MDMA, otherwise known as Molly or Ecstacy;
  • Anabolic steroids;
  • Ritalin and other ADHD medications;
  • Barbiturates and benzodiazepines, including Xanax, Valium, and Ativan.

Trafficking often involves large quantities of the above drugs, which are transported and distributed to other areas. Even if you are not caught actually distributing these substances, the sheer quantity of drugs in your possession makes it likely that trafficking was your intent.

Under ORC Section 2925.03, drug trafficking or even drug distribution may be charged as a felony crime. Depending on the circumstances and the quantity of drugs involved, which is based on a ‘bulk amount’ set by the state, punishment may include the following: 

  • Quantities less than the bulk amount: This may be charged as trafficking or drug distribution, a fourth degree felony with penalties that may include fines up to $5,000 and up to 18 months in jail.
  • Quantities equal to the bulk amount but less than five times that amount: Charged as aggravated trafficking of drugs, this is a felony in the third degree, with penalties including fines up to $10,000 and up to a five-year jail sentence.
  • Quantities equal to the bulk amount but less than 50 times that amount: Charged as a second degree felony, these charges carry fines of up to $15,000 and up to eight years imprisonment;
  • Quantities up to 100 times the bulk amount: Punishable as a first degree felony, these charges may involve fines up to $20,000 and ten years or more in prison.

When dealing with drug crimes that involve more than 100 times the bulk amount or those that have been distributed over state lines, you could be facing federal charges. Under U.S. Sentencing Commision guidelines, this may involve a mandatory minimum sentence of 20 years or more in a federal penitentiary.
