COMMON TYPES OF TRAFFIC VIOLATIONS
Traffic tickets are issued to drivers who are found to be in violation of the traffic laws listed under Chapter 4511 of the Ohio Revised Code. Depending on the type of ticket and the violation you are charged with, you could be facing numerous points on your license or even license suspension. At Groth & Associates, our Toledo criminal defense lawyers take these types of charges seriously, providing the aggressive legal representation you need to defend you against the following types of traffic violations:
- Speeding violations, including street racing, driving too fast for conditions, and driving over posted speeds;
- Moving violations, including reckless driving, failure to stop for signal, and driving while texting;
- Vehicle operation offenses, such as vehicle misuse, failure to register, and driving under suspension; and
- Drunk driving offenses, such as driving while intoxicated and driving over the legal limit;
- Vehicle accident offenses, including vehicular homicide and manslaughter.

Penalties for traffic offenses involve fines as well as a points system, which is outlined under the Ohio Offense and Conviction Code. This system assigns anywhere from zero to six points on a driver’s license depending on the type of violation they are convicted of. Some violations, such as driving while texting and failure to register, carry zero points, whereas others, such as speeding, drunk driving, and reckless driving, vary depending on the specific circumstances and may carry the maximum amount of points. These points can result in higher insurance premiums, as well as driver license suspension, if enough points are accumulated or you are convicted of certain types of offenses. According to the Ohio Bureau of Motor Vehicles (BMV), drivers who accumulate six points on their license over a six-year period will receive a warning letter, while drivers with 12 or more points face license suspension. The suspension may last for six months or more, and in order to have your license reinstated you will be required to do the following:
- Complete a remedial driving course;
- Pay all associated reinstatement fees;
- File a certificate of insurance; and
- Retake the driver license exam.
