HOW CAR ACCIDENTS HAPPEN: DETERMINING WHO’S AT FAULT
Every year, car accidents are a leading cause of injury and death. One of the most tragic elements of car accidents in the fact that the majority of car accidents are entirely preventable; they would not occur but for the negligence of one of the parties involved. Most car accidents occur because of a driver’s error or carelessness, including acts such as:
- Driving while intoxicated;
- Driving while distracted;
- Using a handheld device;
- Driving aggressively; or
- Performing an illegal maneuver.
However, while most car accidents are caused by drivers’ behaviors, this is not the cause of all car accidents. In addition to driver negligence, poor road conditions, weather conditions, and vehicle defects may contribute to or cause an accident as well. If road conditions or vehicle errors are to blame, the respective parties (municipality, for example, or vehicle manufacturer) could be held liable for damages.

HOW DO NO-FAULT LAWS WORK IN MICHIGAN?
While one party involved in a Michigan car accident may clearly be at fault for the accident, Michigan’s no-fault system may preclude the injured party from bringing a claim against the at-fault party. To be sure, as explained by the Michigan Department of Insurance and Financial Services, no-fault insurance pays for medical expenses, lost wages benefits, replacement services, and damages that you cause to another’s property regardless of fault. As such, after a crash, you will file a claim with your own insurance company first, regardless of who caused the accident. In fact, per the no-fault system, you are barred from filing a lawsuit–or having a lawsuit filed against you–following a crash. Instead, you must file a claim against your own no-fault coverage.
STEPPING OUTSIDE OF THE NO-FAULT SYSTEM
The no-fault system exists to prevent litigation and to ensure that those who are injured get some compensation for their harm, regardless of fault. However, there are some situations where people may step outside of the no-fault system and bring a lawsuit against the party whose negligence caused the accident. In general, you may step outside of the no-fault system and bring forth a claim against the other driver’s insurance/file a lawsuit against the at-fault party if:
- You have suffered injuries that are serious, resulting in impairment of a bodily function, disfigurement, or death;
- You are involved in an accident with a party who is not a Michigan resident and who owns a vehicle not registered in Michigan;
- You are involved in an accident in another state; or
- The other party is more than 50 percent to blame for the accident and you need to seek up to $1,000 for damages to your vehicle not covered by the other party’s insurance.
Sometimes, stepping outside of the no-fault system is a must. For those who have suffered serious injuries, the coverage limits that are provided by insurance may not be nearly enough to fully compensate someone for their medical bills, lost wages, and noneconomic losses, such as the value of their pain and suffering.
