DIVORCE IN OHIO: KNOW THE BASICS

Ohio Has a Six Month Residency Requirement

Not everyone can file for divorce in Ohio. If you want to get divorced in Fremont, you must satisfy the residency requirement. Either you or your spouse must have lived in the state for at least six months. As long as one party meets the residency requirement, you should be eligible for an Ohio divorce.

Grounds for Divorce in Ohio

Ohio law allows for both no-fault divorce and fault-based divorce (ORC § 3105.01). Though, the vast majority of couples in our state choose to separate on no-fault grounds. With a no-fault divorce, neither person needs to prove that the other did anything wrong to cause the breakdown of the marriage. Instead, divorce can be sought on the grounds of incompatibility. Incompatibility is sometimes referred to as “irreconcilable differences” or “insupportability.”

Your Option for Dissolution of Marriage

Beyond traditional divorce, Ohio also allows many couples to separate using a non-adversarial, no-fault process called a dissolution of marriage. It has the same legal effect of a divorce. Though, some couples prefer to get a dissolution of marriage instead of a divorce for personal reasons.

WHAT IS THE DIFFERENCE BETWEEN A CONTESTED AND AN UNCONTESTED DIVORCE?

Marital separations fit into one of two broad categories: contested divorces and uncontested divorces

Contested Divorce Lawyer in Fremont, OH

A contested divorce is simply one in which the parties were unable to reach a final agreement on their own. In other words, they will need a judge to step in to decide on one or more important issues. A couple getting a contested divorce is on the path to ligation. However, there are many steps to the process and many contested divorces are eventually settled before a trial. If you are preparing for a contested divorce in Fremont, our Ohio divorce lawyer can help.

Uncontested Divorce Lawyer in Fremont, OH

In contrast, an uncontested divorce is one in which the couples have been able to reach their own settlement on all relevant matters. When possible, an uncontested divorce can save time, money, emotional distress, and a lot of other headaches. Still, reaching the settlement needed to get an uncontested divorce can be challenging. Divorcing couples often use mediation or other forms of structured negotiation to help them reach an agreement. Our Fremont uncontested divorce attorneys have extensive experience helping clients find reasonable, effective solutions.

WORDS FROM OUR CLIENTS

Our experience with Attorney Stevin Groth was nothing short of life changing.
When we first contacted Mr. Groth, he gave us his cell phone number and we were able to directly contact him day or night. His knowledge of the Ohio judicial system was astounding. He handled all aspects of our case himself, never once handing off our case to jr. associates. Stevin had positive relationships with all the judges, district attorneys and court personal that we came in contact with. Stevin’s persuasive arguments on our son’s behalf cleared him of all charges. Because of Stevin’s abilities, our son is able to move forward with his life without the stigma of a criminal record. We could not recommend Stevin Groth more highly.

ALFRED & JENNIFER

Dan is an amazing attorney. He had my divorce finalized in a short period of time. A lot quicker than I thought it was going to be and for that I’m thankful! Dan knew exactly what he was talking about. Any questions I had Dan, and his assistant, Michelle was glad to answer. The outcome of my divorce was exactly what I was hoping for.
Thank You Dan for your services!

WE OFFER COMPREHENSIVE LEGAL REPRESENTATION TO OUR CLIENTS

There are no legal issues more personal or more sensitive than the ones involving your own family. When you are going through a divorce, you need a lawyer who truly provides comprehensive representation. At Groth & Associates, our Fremont divorce attorneys will help you resolve all of the issues in your case, including:

  • Property Division: Ohio is an equitable distribution state. While the separate property will not be divided in a divorce, all of a couple’s marital property will be split in an equitable (fair) manner. Our Fremont, OH property division lawyers will help you negotiate a settlement, protect your rights, and get your fair share of the marital assets. We have experience handling complex property division cases.
  • Spousal Support: Depending on your financial circumstances, you may be entitled to receive or be ordered to pay alimony. Also referred to as spousal support or spousal maintenance, alimony consists of ongoing payments made by the financially advantaged spouse to their former partner after a divorce. Alimony is not guaranteed in Ohio.
  • Child Custody: If you and your spouse have young children, it is imperative that you take action to protect your custody & visitation rights. Ohio uses the best interests of the child standard in resolving these cases. The child’s needs will always come first. Our Fremont child custody lawyers will help you find an agreement that works for your family while protecting your parental rights.
  • Child Support: Under Ohio law, parents are responsible for financially supporting their children. A non-custodial parent may be required to make ongoing child support payments to their former partner. Our Fremont, OH divorce attorneys have experience handling the full range of child support cases.

Ultimately, no two marriages are exactly alike. As such, every divorce should be handled on a case-by-case basis. If you are separating from your spouse in Fremont, our law firm is here to provide personalized guidance and representation. With a long record of satisfied clients across a wide range of legal cases, we are here for you.
